I would stick with just smart. I doubt that he wanted to shell out patent and or trademark money and engage in any litigation. Now it’s NYT property and they have the deep pockets to do so. Cashing out while this is in an upward trajectory makes the most sense… in a year from now it might be Wordle who? The public is fickle.

Smart and not-so, at the same time. It went nuclear so he didn't have time, but he or NYT could patent the game and also get a design patent for the look of it as well. The road is tougher now, I think, but not impossible. Lazy knows for sure.
