I don't think it's ever happened that a president nominated someone and got him confirmed in that period (inauguration day used to be later in February tho). If this guy Garland is nominated now, though, and the nomination sits unaddressed until then, I can see the Senate deciding to act, especially if in some weird scenario where the Democrats take the senate but Trump wins the white house.
Yeah I think it's weird that the court would have that particular litmus test.
Maybe someday some nominee or candidate for office will answer the question: "What are your religious beliefs and how will they influence your decision-making?" with "The constitution guarantees the separation of church and state. Next question."

Would be interesting to see who he'd nominate if he could choose anyone... Garland's jewish, so the court will be 5 Catholics & 4 Jews. 0 protestants, 0 any other frickin' religion of any kind (I was hoping for Sri), 0 unaffiliated.
